I received a reply on May 20, 1998, stating that the Arkansas Attorney General had issued an official opinion in 1993 (#93-270) that a real estate essay contest "may run afoul of the Arkansas statutes on gambling, found in Chapter 66 of Title 5 of the Arkansas Code of 1987, as amended (A.C.A. § 5-66-101 to -119)." Proceed with caution. However, this opinion has not apparently been tested in state court. An Arkansas attorney should be able to review the state's gambling laws and counsel as to whether you might be able to structure a contest that eliminates any element of chance within the competition.
